Welcome to Shghul. These Terms and Conditions ("Terms") govern your use of the Shghul mobile application ("App") operated by Shghul ("Company," "we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Definitions
"User" refers to any person who accesses or uses the App
"Job Seeker" refers to users seeking employment
"Employer" refers to companies or individuals posting job listings
"Content" refers to all information, text, images, and materials on the App
"Services" refers to all features and functions provided by the App
2. Eligibility
To use the App, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into binding agreements
- Provide accurate and complete registration information
- Not be prohibited from using the App under applicable laws
3. Account Registration
- You must create an account to access certain features
- You are responsible for maintaining the confidentiality of your login credentials
- You are responsible for all activities that occur under your account
- You must notify us immediately of any unauthorized use of your account
- We reserve the right to suspend or terminate accounts that violate these Terms
4. User Conduct
You agree NOT to:
- Provide false, misleading, or inaccurate information
- Impersonate any person or entity
- Post fraudulent job listings or applications
- Harass, abuse, or harm other users
- Send spam or unsolicited communications
- Upload malicious content or viruses
- Attempt to gain unauthorized access to the App or its systems
- Use the App for any illegal purpose
- Scrape, collect, or harvest user data
- Interfere with the proper functioning of the App
5. Job Seeker Terms
- You are responsible for the accuracy of your profile and resume
- You grant employers permission to view your profile when you apply for jobs
- We do not guarantee employment or job placement
- You are responsible for verifying the legitimacy of job listings and employers
- Any employment relationship is solely between you and the employer
6. Employer Terms
- You must provide accurate company and job listing information
- Job listings must comply with all applicable employment laws
- You must not post discriminatory job requirements
- You are responsible for your hiring decisions and employment practices
- You must have authorization to post jobs on behalf of your company
- Premium services may be subject to additional fees and terms
7. Content Guidelines
All content posted must:
- Be accurate and not misleading
- Not infringe on intellectual property rights
- Not contain offensive, discriminatory, or illegal material
- Not contain personal contact information in public fields (to prevent spam)
- Comply with all applicable laws and regulations
We reserve the right to remove any content that violates these guidelines without prior notice.
8. Intellectual Property
- The App, including its design, features, and content, is owned by Shghul
- You may not copy, modify, or distribute our intellectual property without permission
- You retain ownership of content you submit but grant us a license to use it for operating the App
- Trademarks, logos, and service marks displayed are our property or licensed to us
9. Fees and Payments
- Basic services for job seekers are free
- Employers may be charged fees for premium features and job postings
- All fees are non-refundable unless otherwise stated
- We reserve the right to change pricing with reasonable notice
- Payment processing is handled by secure third-party providers
10. Disclaimers
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
We do not guarantee:
- The accuracy of job listings or user profiles
- That you will find employment or suitable candidates
- Uninterrupted or error-free service
- The conduct or legitimacy of other users
We are not responsible for:
- Employment decisions made by employers
- Actions or conduct of users
- Third-party content or links
- Loss of data or service interruptions
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We shall not be liable for any indirect, incidental, special, or consequential damages
- Our total liability shall not exceed the amount you paid us in the past 12 months
- We are not liable for any loss arising from your use of the App
12. Indemnification
You agree to indemnify and hold harmless Shghul, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:
- Your violation of these Terms
- Your use of the App
- Your content or information
- Your violation of any third-party rights
13. Privacy
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
14. Termination
- You may terminate your account at any time by contacting us
- We may suspend or terminate your account for violation of these Terms
- Upon termination, your right to use the App ceases immediately
- Sections that by their nature should survive termination will remain in effect
15. Modifications
We reserve the right to modify these Terms at any time. Changes will be effective upon posting in the App. Continued use of the App after changes constitutes acceptance of the modified Terms.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Kuwait, without regard to conflict of law principles.
17. Dispute Resolution
Any disputes arising from these Terms or your use of the App shall be resolved through:
- Good faith negotiation
- Mediation (if negotiation fails)
- Binding arbitration in Kuwait (if mediation fails)
18. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
19. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Shghul regarding the use of the App.
